Plan Corrections

From time to time, an Alberta Land Surveyor may discover either a clerical error or perhaps an error affecting a boundary on a plan of survey registered at Alberta Land Titles.
 

If the Alberta Land Surveyor is still practicing

If the Alberta Land Surveyor who registered the plan is still practicing and the matter is “an omission, clerical error or other defect” the plan is relatively easily fixed.

If the Alberta Land Surveyor who registered the plan is still practicing but the matter involves changing boundaries, then resolution is more complex, takes more time, and will almost always require landowner consents.

It is the Alberta Land Surveyor’s professional responsibility to correct their plan of survey.
 

If the Alberta Land Surveyor is no longer practicing

What if the Alberta Land Surveyor is no longer practicing? In these situations, a practicing Alberta Land Surveyor may apply to the Council of the Alberta Land Surveyors’ Association…

…to (in the case of a clerical error) be appointed and authorized to consent to the correction of a plan under Section 92 of the Land Titles Act

or

…to (in all other situations) be appointed and authorized to make an application for an order under Section 91 of the Land Titles Act to vary a plan.
 

Responsibility

An Alberta Land Surveyor appointed under either Section 91 or Section 92 of the Land Titles Act assumes full responsibility for the corrections made.
 

Template

An Alberta Land Surveyor who wishes to make an application to be appointed by Council under either Section 91 or Section 92 of the Land Titles Act may use the attached template.

Once the application is received and it is in order, it will be addressed by Council at its next meeting.
 

No Inferences

Please note there are many reasons why a survey plan may need to be corrected. No one should infer any negligence or lack of professionalism if an Alberta Land Surveyor’s plan needs to be corrected under Section 91 or Section 92 of the Land Titles Act.
